Terms and conditions
1. INFORMATION ABOUT US
The Site is operated by Logicalskincare (“Logicalskincare”) with its registered office at 5455 Clarkston Road, Muirend, Glasgow, G44 3LW.
2. YOUR STATUS
By purchasing Products through our Site, You agree that:
2.1 You are legally capable of entering into binding contracts; and
2.2 You are at least 18 years old.
3. FORMATION OF CONTRACT
3.1 When you receive communication from Logicalskincare all correspondence will be sent to the email address you register with us.
3.2 After placing an order with Logicalskincare, you will receive an email confirming the order details. This email will contain delivery arrangements and details. Should you find that the details on our confirmation email are incorrect, you should contact us immediately. Please also get in touch if you fail to receive an email from Logicalskincare at your registered email address at the time an order is placed.
3.3 A second email sent to your registered email address acts as a sales agreement between Logicalskincare and you, the purchaser, and confirms that your order has been processed and shipped.
3.4 All orders are subject to acceptance by us and the contract will only be formed when we dispatch the goods.
3.5 The products will be at your risk from the time of delivery.
3.6 Ownership of the Products will only pass to you when the goods are delivered to the address you requested when ordering and when we receive full payment of all sums due in respect of the products including delivery charges where applicable .
4.1 The price of any products is inclusive of VAT (at the UK prevailing rate) but exclude delivery costs where applicable. Prices can change at any time, but changes will not affect any orders you have placed prior to the date of the change and which we have accepted. We will however, try to provide reasonable notice of any price increases. We shall try to ensure accuracy of pricing. If, however, there is an error in pricing your order, we will contact you immediately. In the case of an overpayment, we will adjust the total cost of the order in your favour. Where a product has been under-priced, we will honour that price and the original payment will stand.
Some purchases outside of the UK will be subject to import duties and taxes. All such charges are imposed on arrival in the designated country and are the responsibility of the purchaser. These charges will vary depending on the designated country.
4.2 If Logicalskincare cannot, for any reason, complete your order you will be contacted as soon as possible. If you do not wish to wait until we can provide the product, you will have the right to a full and immediate refund.
4.3 At Logicalskincare we provide free samples with all purchases. We will always try to supply the samples requested but reserve the right to change the product sample at any time.
4.4 Logicalskincare reserves the right to cancel a sale and alter the sale or availability of products at any time. If Logicalskincare cancels an order, payment will be refunded in full and a purchaser’s statutory rights will not be affected.
4.5 No additions or changes may be made to an order once placed.
5.1 Delivery charges are clearly stated on Logicalskincare’s homepage, on the delivery section of this document and again at checkout.
5.2 All payments must be received before an online order can be shipped. Payment is made using the options at checkout through the secure site. Payment is subject to Worldpay or Sagepay’s terms and conditions. We will charge your credit or debit card prior to despatching goods.
5.3 Please be aware that all order invoices and emails must be sent to the billing address. In the case of a purchase of voucher or gift, it will not be possible to send correspondence to the delivery address, only to the billing address.
5.4 Please be aware that your card details are secure and that you can shop with confidence on Logicalskincare’s website as your card details are encrypted to minimise the possibility of anyone using them.
6. Shipping and delivery
6.1 All delivery charges are automatically added at checkout before entering your card details. Please see below for delivery charges where applicable.
6.2 For recorded or special delivery packages, be aware that a signature will be required therefore please ensure an address is given where someone is available to sign for the package otherwise it will be taken to a sorting office for collection. Please note that, in the case where a product has been returned to us due to a failure to collect, we will expect to pass on any costs incurred.
6.3 All orders received at Logicalskincare by 2.00pm Monday to Friday (excluding Bank holidays) will be despatched on the same day and all orders will be delivered by Royal Mail.
6.4 Second class free delivery is offered on all purchases. First class delivery usually involves next day delivery, but this is not guaranteed.
6.5 Orders over £150 (UK mainland only) will be sent next working day Royal Mail Special Delivery to a designated delivery address free of charge. Orders over £60 up to a value of £150 will be sent Royal Mail Signed For free of charge. These deliveries are tracked at every stage.
6.6 Logicalskincare may divide your purchase into two or more batches due to Royal Mail insurance policy.
6.7 All packages to Europe will be sent using Royal Mail’s airmail service. As with UK orders, all purchases placed by 2.00 pm Monday to Friday (excluding bank holidays) will be posted the same day.
Charges to Europe and outwith Europe are as follows:
£4.95 for orders up to a value of £60
£9.95 for orders up to a value of £150 (sent Air Mail International Sign For)
£14.95 for orders over £150 (sent Air Mail International Sign For)
6.8 All orders will be followed by an email confirming shipping arrangements.
6.9 Once a package leaves Logicalskincare, we cannot be held responsible for any delay in delivery as it is in the care of Royal Mail and we cannot be held responsible for any loss incurred due to late delivery. We suggest, therefore, you order in good time from Logicalskincare to avoid any disappointment.
6.10 If a package is lost Royal Mail will only class this as a lost package when:
15 working days have lapsed for UK orders
20 working days have lapsed for EU orders
25 working days have lapsed for rest of the world orders
At the end of this time period Royal Mail will respond to any claims for lost packages and Logicalskincare will be happy to pursue claims on your behalf.
7.1 At Logicalskincare we hope you will be fully satisfied with your order. You have the opportunity to consult with a fully trained Dermalogica Expert, the most highly qualified status offered to a Dermalogica Adviser. However, in line with Dermalogica’s 100% Satisfaction Guarantee, should you be unhappy with your choice of product, we at Logicalskincare will accept a return of a product. Furthermore, should you find that you have ordered an incorrect product or wish to change your mind you will receive a full refund (excluding P & P). Postage costs will only be met by Logicalskincare in the event of the receipt of a faulty or incorrect package.
7.2 Refunds will be made once a returned product is received and checked by Logicalskincare. You must inform Logicalskincare immediately you wish to return a product and it must be returned at your own cost and risk. We strongly advise you to insure your returned product against being lost in the post or send as a tracked item. We cannot be held responsible for any items lost or delayed.
7.3 Refunds will be made to the account the purchase was made from.
You have the right to return a product up to 28 days following delivery.
7.4 Refunds will be made as soon as possible and certainly within 7 days from the date we are in receipt of the returned product.
7.5 If you intend to make a purchase in the near future, we will be happy to send a voucher code to the value of the total amount for use with your next order.
7.6 Refunds will not be accepted where a purchase was made as a gift package.
8. Faulty products
8.1 All attempts are made to ensure products are packaged to prevent damage whilst in transition. However, should you receive a product that has been damaged or is incorrect, we will replace the item free of charge or offer a full refund (including return postage cost) on receipt of the product. This return must be made within 30 days of receipt of the product.
Please obtain proof of posting to allow us to refund cost of posting.
8.2 For refunds/faulty products, please provide details of the product you are returning together with the order number and a reason for the return of product to us at:email@example.com

Please remember to get in touch immediately should you wish to arrange a refund.
9.1 You can cancel an order on logicalskincare website up to the point of making your secure payment at checkout.
9.2 Beyond this stage, you will have to contact us at firstname.lastname@example.org. You should do this as soon as possible after placing the order; although our 28 days returns policy does apply here.
Once your order has been delivered, you should follow the procedures for refunds.
10.1 It is important to us at Logicalskincare that we protect your privacy. We will only use information about you that we have been given by you in accordance with the Data Protection Act 1998.
10.2 When you place an order with Logicalskincare we will need to ask you for some personal information. This information will be held securely and will be used to:
· process your order and manage your account.
· keep a record of our correspondence together, including visits to our site and transactions.
· help prevent fraud – we may wish to check card details.
· allow us to offer you a very personal service.
10.3 As part of managing your account, you will be asked to provide your chosen password each time you login. It is your responsibility to keep this password private. Information transferred over the internet cannot always be completely secure but we will always try to protect your personal information but cannot guarantee this. All information passed to us is done so at your own risk. However, we can assure you that strict procedures are in place to protect your personal data.
Please be assured that all payment transactions are encrypted.
10.4 At Logicalskincare, we would also like to use your personal information to update you on offers or news items which may be of interest to you.
If you do not wish to receive this information please untick the relevant box, although we would prefer to be allowed to alert you to exciting offers, new products and updates.
Logicalskincare’s website will be regularly updated and the content may, at times, change. We will always endeavour to ensure all information is up to date at all times, but this cannot be guaranteed.
11. Limitation of Liability
11.1 Logicalskincare’s liability for losses you suffer as a result of Logicalskincare breaking this agreement is strictly limited to the purchase price of the Products ordered and any losses which are a foreseeable consequence of Logicalskincare breaking the agreement. Losses are foreseeable where they could be contemplated by Logicalskincare and the Customer at the time the order was accepted by Logicalskincare.
11.2 Neither Logicalskincare Limited nor any of its Directors will be responsible for any damage caused during the use or misuse of the Site or from any information contained therein. All material and information presented by Logicalskincare is intended to be for educational or information purposes only. The information and products are not intended to diagnose, treat, cure or prevent any condition or disease. Please consult your own doctor or health practitioner regarding the suggested recommendations made at Logicalskincare.
12. Notices and communications
12.1. When using our Site, Customers accept that communication with Logicalskincare will be mainly electronic. Logicalskincare will contact Customers by e-mail or provide Customers with information by posting notices on the Sites. For contractual purposes, Customers agree to this electronic means of communication and Customers acknowledge that all contracts, notices, information and other communications that Logicalskincare provide to Customers electronically comply with any legal requirement that such communications be in writing. This condition does not affect Customers statutory rights.
12.2. All notices given by Customers to Logicalskincare must be given to Logicalskincare Limited at email@example.com. We may give notice to Customers at either the e-mail or postal address Customers provide when they become an authorised account, or as subsequently provided in writing to the above address as held within the Site on ‘My Details’. Notice will be deemed received and properly served immediately when posted on the Site, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail,that such e-mail was sent to the specified e-mail address of the addressee.
12.3. Order acknowledgements will be sent to the e-mail address currently held for the Customer’s account.
13. TRANSFER OF RIGHTS AND OBLIGATIONS
13.1 The contract between Logicalskincare and the Customer is binding on Logicalskincare and the Customer and on our respective successors and assignees.
13.2 Customers may not transfer, assign, charge or otherwise dispose of a Contract, or any of the Customers rights or obligations arising under it, without prior written consent from Logicalskincare.
14. EVENTS OUTWITH OUR CONTROL
14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of their obligations under a Contract that is caused by events outside our reasonable control (a “Force Majeure Event”).
14.2 The performance of Logicalskincare under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and Logicalskincare will have an extension of time for performance for the duration of that period. Logicalskincare will use reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which their obligations under the Contract may be performed despite the Force Majeure Event.
15.1 If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
16. These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract for Online Trading and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
17. Any variation to these terms and conditions shall have no effect unless expressly agreed in writing and signed by an authorised representative of Logicalskincare.
18. The information and materials contained in these pages - and the terms, conditions, and descriptions that appear - are subject to change.
19. LAW AND JURISDICTION
19.1 Any and all disputes arising between Logicalskincare and the Customer will be subject to the non-exclusive jurisdiction of the Scottish courts and the Contract shall be governed by Scots law.
